Under historical practice, prospective founders frequently overstepped into early operations while awaiting their visas, relying on ImmD’s informal tolerance during the setup phase. Today, because ImmD insists that commercial leases be signed, funds deployed, and local staff placed on active MPF-compliant payroll prior to approving an Entrepreneur Visa, foreign visitors face severe exposure to accusations of unlawful employment. The guidance must emphasize establishing formal local governance—appointing resident directors or corporate service managers to execute operational tasks—keeping the foreign founder strictly within passive, non-operational boundaries until entry clearance is endorsed.
