I have given this talk around town for the last couple of years now and so pleased to finally add it to our coverage of the Hong Kong investment visa, specifically discussing the distinction between an employment visa and an entrepreneur visa (Work Visa vs Investment Visa).

• Comparative Reading Under the Upgraded Regime: The historical flexibility between these two routes has been eliminated. If an applicant holds a material or controlling equity interest in the sponsoring company, ImmD immediately pierces the corporate veil and assesses the application under the hardened GEP Entrepreneur standards. Attempting to use the employment route as a low-capital shortcut backfires entirely: reclassification under the entrepreneur regime subjects the venture to the mandatory HKD 1.5M–2.0M capital deployment, dedicated physical “four walls,” and day-one local payroll mandates, resulting in summary requisitions or outright refusal for asset-light startups.
