PRACTICE UPDATE: How the content must now be read in light of current ImmD policy:
Historically, this installment in the DIY Visa Guide series served as the empirical proof of concept for the self-filing philosophy: real-world case studies demonstrating how diverse, independent founders successfully navigated the Investment as Entrepreneur visa process under the General Employment Policy (GEP) without paying professional fees. The Geeza unpacked varied founder profiles—from solo marketing consultants and bespoke sourcing agents to niche creative directors and boutique advisory operators—showing how each secured approval by leaning into authentic commercial storytelling. In that era, the case studies illustrated the sheer breadth of ImmD’s administrative discretion. Success did not require deep institutional backing, massive balance sheets, or immediate local teams: an applicant could comfortably carry the day by demonstrating genuine intent, committing modest seed savings of a few hundred thousand dollars, taking a flexible hot desk or serviced office suite, and presenting a credible, phased roadmap to hire local staff over a two- to three-year ramp-up period.
The game has changed from an inspiring portfolio of accessible founder pathways into a historical museum of extinct application profiles. Under post-April 2026 administrative practice aligned with TTPS Category A operational substance (~HKD 2.5M enterprise scale), every single case study celebrated in this historical post would now result in swift, summary refusal. ImmD has completely excised discretionary leniency and commercial storytelling for un-incubated ventures. The solo practitioner, the lean marketing consultancy, the home-based sourcing operator, and the boutique agency are no longer viable under independent entrepreneur adjudication. ImmD’s statutory “substantial contribution to the economy of the HKSAR” test has been flattened into a rigid, binary compliance audit requiring non-negotiable corporate hardware audited on day one: HKD 1.5M–2.0M in deployed corporate bank liquidity sitting in a local bank account, an executed commercial lease for exclusive physical premises (“four walls”) that strictly disqualifies serviced offices, virtual addresses, and co-working desks entirely, and active Mandatory Provident Fund (MPF) payroll contributions for 2–3 local Hong Kong permanent residents.
Consequently, reading these historical case studies as viable blueprints today creates a dangerous trap for prospective founders. The foundational assumption across each case—that a self-represented entrepreneur could bootstrap a lean venture from a shared workspace and phase in overhead over time—has been outlawed by administrative practice. The sole surviving framework where early-stage, lean founder profiles can legally avoid these crushing day-one hardware mandates is through formal, documented admission into an officially accredited government incubator (such as Cyberport, HKSTP, or the Design Incubation Programme). Outside this accredited institutional safe harbor, independent applicants attempting to replicate the historical case studies will face immediate refusal, instantly extinguishing lawful stay and permanently breaking any accumulated ordinary residence toward Right of Abode.
