– The Catch 22 –
First Published February 28, 2013 – But The Advice Holds Good Today
PRACTICE UPDATE: How the content must now be read in light of current ImmD policy:
Historically, this guide addressed the classic administrative Catch-22: how to establish a commercial presence in Hong Kong when you cannot legally work or manage operations without a visa, yet ImmD requires an established business before granting one. The Geeza reassuringly dismantled this paradox by advising founders to leverage administrative pragmatism. Applicants could assemble their application as an overseas investor or temporary visitor, sign provisional agreements, utilize virtual or serviced business addresses, hold lean capital reserves in readiness, and rely on persuasive, conditional business plans that promised capital injection and local recruitment once immigration clearance was officially secured.
The game has changed from a navigable chicken-and-egg paradox solved by conditional promises into a merciless institutional stress test where ImmD demands full, upfront operational execution. The department no longer tolerates prospective commitments or conditional launch plans; the Catch-22 has been resolved by placing 100% of the commercial risk on the applicant before adjudication begins. To pass muster today under TTPS Category A substance standards, a founder must have already cleared HKD 1.5M–2.0M into a functional Hong Kong corporate account, locked in an executed commercial lease for exclusive physical premises (“four walls”), and put 2–3 local permanent residents on active MPF payroll. Without deploying this institutional footprint upfront—or securing entry through an accredited government incubator—treating the startup sequence as a flexible, conditional process ensures swift and summary refusal.
On January 17, 2013 I gave a talk at Centre O in Wanchai on how to go about applying for a Hong Kong business investment visa without the need to pay for any professional help.
The 30 minute talk was broken down into 24 very easy to digest segments and each of these segments is presented here.
The talk is designed to allow the D-I-Y visa applicant to use the 100% free resources of both the Hong Kong Visa Handbook as well as the Hong Kong Visa Geeza Blog.
